PROMOTION PARTIES: TEXAS BORN, INC. dba TXB and its affiliates and subsidiaries (the “Sponsor”) and PAYTRONIX & BRANDMOBILE and its affiliates and subsidiaries (the “Administrator”) (the Sponsor and Administrator are collectively the “Promotion Parties”) are the sponsor and administrator of the TXB SCRATCH TO WIN GAME (the “Game” or the “Sweepstakes”) pursuant to the following terms and conditions (the “Official Rules”).
SWEEPSTAKES PERIOD: The Sweepstakes begins on April 02, 2025, at 12:01 a.m. CST and ends on August 31, 2025, at 11:59 p.m. CST (the “Sweepstakes Period”).
ELIGIBILITY: The Sweepstakes is open to TXB LOYALTY APP Members who are Texas or Oklahoma residents and are at least 18 years old at the time of entry. Employees of TXB/Kwikchek and other companies associated with the promotion of the Sweepstakes, and their respective parents, family members, subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible for Grand Prize, Grand Prizes, or any of the prizes not redeemable in store. The Sweepstakes is subject to federal, state, and local laws and regulations. TXB LOYALTY APP Members must have their Location Services turned on to access the Game. To win the Grand Prize, participants must have a valid driver’s license. Participants must be of legal age, 18 years or older. The Grand Prize is limited to residents of the states of Texas and Oklahoma.
HOW TO ENTER: Open your TXB REWARDS APP and click DEALS/GAMES to find the “Scratch & Win” Game. The Game utilizes a digital scratcher that can be “scratched” using your finger on your mobile device within the app. Match 3 of the same items to win that prize. Once you have matched the 3 items, click on “Get Offer” and then “Redeem” to pull up the coupon barcode or prize instructions. Follow the instructions on the coupon to redeem your prize.
On-Site: This method of entry will be available at participating TXB Locations throughout Texas and Oklahoma.
Limit one (1) entry per person, per day, per email address, and per household for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.
PRIZES:
1. GRAND PRIZE
One (1) Grand Prize Winner will receive a 2025 GMC Sierra Elevation (ARV): $59,130. The winner is responsible for all applicable taxes, registration, title, licensing fees, and any other expenses not specifically listed as part of the prize. The prize is non-transferable and cannot be exchanged for cash or any other item. The Sponsor reserves the right to substitute a prize of equal or greater value for any reason whatsoever, in Sponsor’s sole and absolute discretion.
Eligibility Period: The “GMC Sierra Elevation” contest period commences at 12:01am CST on April 2, 2025 and concludes at 11:59pm CST on August 31, 2025.
Entry Conditions: During the contest period, participants can only earn a maximum of one (1) entry per day by playing our game.
Limit: TXB Employees and immediate family members living in same household are prohibited from winning the Grand Prize.
2. INSTANT PRIZE DETAILS:
• Instant Win Prizes will vary daily from Free Product, Buy 1 Get 1 Free coupons, and Bonus Points. Instant Win Prizes must be redeemed the same day or prize will expire at 11:59pm CST the following day. All Instant Win Prizes are loaded to TXB Rewards Members Loyalty Account & are redeemed by scanning Loyalty at time of redemption.
• Instant Win Prizes are limited to 1 redemption per day and cannot be combined with other digital offers and in-store promotions.
Eligibility Period: The Sweepstakes contest period commences at 12:01am CST on April 4, 2025, and concludes at 11:59pm CST on August 31, 2025.
INSTANT-WIN PRIZES & GRAND PRIZES RESTRICTIONS: Only one instant prize game play is available per guest per day. For each winning Game Play, the Instant-Win Prize will be loaded to TXB REWARDS Account for Redemption. Redemption for certain prizes may not be available at every store; in the event a prize is unavailable when the winner attempts to redeem, the winner can either visit a different location or come back at a later time within the redemption window. Acceptance of an Instant Win Prize-or Grand Prizes constitutes permission to TXB to use winner’s name, likeness and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply. Grand Prizes are limited to the following quantities and winners are selected randomly by BrandMobile Global Marketing LLC Gamification Company and approved by TXB. Grand Prize Winners must claim prize within 30 days of being awarded. Unclaimed/unredeemed Instant-Win or Grand Prizes will not be awarded. There is no guarantee that all Instant Win Prizes will be awarded. Winners may not substitute or transfer any Instant-Win Prize or Grand Prizes, however, TXB reserves the right to substitute alternate prizes based on availability. Potential winners may be subject to verification before prize is awarded.
6. GRAND PRIZE WINNER SELECTION & NOTIFICATION:
On or about the first week of September 2025, the Administrator will randomly select one (1) entry for the Grand Prize described above in a random drawing of all valid entries received. The potential winner will be contacted via text message (or call) using the contact details provided with the entry and may be awarded the prize subject to verification of eligibility and compliance with the terms of these Official Rules. The potential winner will be notified on or about two to seven days after the drawing. Failure by potential winner to respond to the initial verification within five (5) days of notification will result in disqualification and Administrator will select an alternate potential winner in the same manner. Odds of winning the grand prize depend on the number of eligible entries received during the Sweepstakes Entry Period.
The potential Grand Prize winner will be required to complete, electronically sign, and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent in order to claim his/her prize. If a potential winner cannot be contacted or fails to submit the Declaration of Compliance within the required time period, or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from and among all remaining eligible entries. The winner must complete and return a 1099-MISC and IRS W-9 form (i.e., Request for Taxpayer Identification Number and Certification). A prize will only be awarded if the potential winner fully complies with these Official Rules.
If necessary, only ten (10) alternate drawings will be held, after which the Grand Prize will remain un-awarded.
7. PUBLICITY RELEASE:
By accepting the prize, the winner grants Sponsor and its affiliates the right to use their name, likeness, voice, and biographical information for promotional and advertising purposes without additional compensation, except where prohibited by law.
8. GENERAL RULES:
TXB reserves the right to cancel, suspend and/or modify the SWEEPSTAKES or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the game, as determined by TXB in its sole discretion and if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to termination. TXB Reserves the right to in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operations of the SWEEPSTAKES or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. TXB’s failure to enforce any term of the Official Rules shall not constitute a waiver of that provision.
Participation in the SWEEPSTAKES constitutes your full and unconditional agreement to and acceptance of the Official Rules and to TXB’s decision in all matters related to the SWEEPSTAKES, which are final and finding at its sole discretion.
Liability for any irregular entry or errant winning announcement will be limited to replacement with another chance to win. If through occurrence of, production, notification, computer, electronic or any errors whatsoever, more winning notifications are offered and distributed than those prize quantities offered in the Official Rules, no more than the actual number of prizes per these Official Rules will be awarded. Should such a situation occur, winners will be determined in a random drawing from among all submitted eligible and verified winning prize claims for the specific prize at issue. Winners acknowledge that Sponsor and all other businesses concerned with this Game and their agents do not make, nor are in any manner are responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of a prize. By entering into the Sweepstakes, participant agrees to accept the prize as-is, in its present condition, with all defects, known or unknown, patent or latent, and without representations or warranties, express or implied. Any prior oral or written statements concerning the condition of the prizes, whether made by Sponsor, Sponsor’s agents, or third parties, are expressly disclaimed. This “as-is” clause is a material term but for which the sponsor would not have agreed to sponsor the Sweepstakes.
9. RELEASE OF LIABILITY:
By participating in this Game, you release, defend and hold harmless Promotion Parties from all liability, claims or actions of any kind whatsoever for injuries, damages, demands or losses of any kind to persons (including death) and property which may be sustained in connection with either directly or indirectly, 1) the awarding, receipt, ownership, use or misuse of any prize awarded herein; or 2) participation in the SWEEPSTAKES or any prize related activities, including but not limited to traveling to or from any prize related location. Sponsor is not responsible if SWEEPSTAKES cannot take place or if any prize cannot be awarded due to product shortages, delays or interruptions due to acts of God, acts of war, natural disasters, weather, pandemic or acts of terrorism. Sponsor is not responsible for any typographical, technological or other error in the printing of the offer or any codes, algorithms, or other administration of the Game or in the award or announcement of the prizes. Promotion Parties are not responsible for late, lost, damaged, inaccurate, delayed, garbled, misdirected, incomplete, or undelivered entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries or codes, the announcement of the prizes, or in any Sweepstakes-related materials. Promotion Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Game. Promotion Parties are not responsible for injury or damage to any person’s computer, smartphone or other technology related to or resulting from participating in Sweepstakes or downloading materials from or use of the app or website. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH
ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT
PERMITTED BY LAW.
GOVERNING LAW: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the State of Texas without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas. In addition, any dispute relating to the Game (including these Official Rules) shall be resolved individually, and without resort to class action, exclusively in the appropriate state or federal court having jurisdiction over the subject matter located in Texas. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non convenes or lack of personal jurisdiction they may have.
10. PRIVACY POLICY:
Information collected from participants is subject to Sponsor’s privacy policy. Sponsor will collect personal data about you to facilitate the Game and for purposes of market research. If you choose to participate in the Game, you grant the Sponsor permission to send Game updates, winner notifications, specials, promotions, newsletters, and/or updates to you. You also permit Sponsor to share your personal data with Administrator for the purposes of Game administration and facilitation.
No personal data will be transferred or sold to any third party except in the following circumstances:
1. When you give us permission to do so;
2. When in good faith we believe the law requires it;
3. Under limited circumstances specifically described to you when we collect the information;
4. To affiliated companies provided that our affiliated companies and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these Official Rules; and
5. To our respective agents, professional advisors, and promotional and marketing agencies, provided that such agents, professional advisors, and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these Official Rules.
Sponsor may utilize aggregate information (printed card number) that contains no specific personally identifiable information. Sponsor may share aggregate information with trading partners, co-branded locations, participating sponsors, and advertisers.
All information submitted by participants and collected by Sponsor in connection with participant’s entry will be subject to and will be treated in a manner consistent with Sponsors’s website privacy policy accessible at: https://txbstores.com/privacy-policy/
11. DISPUTES:
Except where prohibited, each participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fannin County, Texas. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, participants’ rights, and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes shall be governed by and construed under the laws of Fannin County, Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Fannin County, Texas. Each participant hereby absolutely, unconditionally, irrevocably and expressly waives forever trial by jury.
12. WINNER LIST:
To request the winner’s name, send a self-addressed, stamped envelope to TXB, 21018 Hwy 71 West, Suite 300, Spicewood, TX 78669. Winner List requests will only be accepted after the promotion end date (listed above). Please specify “Winner GMC Sierra Elevation” with your request. Requests for the Winner’s List must be received by November 1, 2025.
13. GENERAL TERMS & CONDITIONS
Participation in the Game constitutes the participant’s full and unconditional agreement to and acceptance of these Official Rules and any decisions of Sponsor and Administrator, which are final with respect to all matters relating to the Game. This Game is void outside the jurisdictions specified in these Official Rules and where prohibited by law. The Game is subject to all applicable federal, state, local, and municipal laws and regulations. The participant will be solely responsible to pay any taxes, if applicable, assessed against or associated with the winning of any prize.
By participating in the Game, and as a condition of acceptance of any prize, each participant, his/her heirs, executors, administrators, and assigns, RELEASES AND FOREVER DISCHARGES AND HOLDS HARMLESS the Promotion Parties, their direct and indirect subsidiaries and affiliates, their advertising, promotion and fulfillment agencies and legal and other advisors, and each of their employees, officers, directors, shareholders, partners and agents (collectively, the “Released Parties”), from and against any and all losses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation all costs and liabilities of any kind, including attorneys’ fees), AND INCLUDING WITHOUT LIMITATION ANY LIABILITY ARISING FROM ANY ACT OR OMISSION OF NEGLIGENCE OR INTENTIONAL CONDUCT OF THE PARTICIPANT, that the participant now has, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (a) participation in the Game, or the awarding, acceptance, use, or misuse of any prize, or traveling to, preparing for, or participating in any Game-related or prize-related activity; or (b) the publicity rights granted to the Sponsor and its direct and indirect affiliates as referred to above. It is understood that there may be serious risks of bodily injury, death, or property damage associated with the redemption, use or misuse of any prize, and any prize winner voluntarily assumes these risks.
Prizes shall be accepted “as is.” It is understood that the Promotion Parties have not made any warranty, representation, or guarantee, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, regarding any prize, or any substitute prize. Sponsor reserves the right to cancel or modify the Game or to amend these official rules at any time, for any reason, and without prior notice.
The Released Parties are not responsible for:
1. Any technical, hardware, software or telephone failures of any kind;
2. Lost or unavailable network connections;
3. Failed, incomplete, garbled or deleted computer, electronic or network transmissions or app issues
4. Undelivered coupons due to spam filters, coupon time-out, network connectivity issue or any other reason; or
5. Entry requests or prize claims that are illegible, incomplete, misdirected, lost, late, postage-due, damaged, or ineligible.
