2022 TXB KICK TO WIN SWEEPSTAKES RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. Eligibility

Kick to Win (the “Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of TXB and Kwik Chek and other companies associated with the promotion of the Sweepstakes, and their respective parents, family members, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible for Grand Prizes, Corporate prizes, or any of the prizes not redeemable in store. The Sweepstakes is subject to federal, state, and local laws and regulations.

App users must have their Location Services turned on in order to access the game on their app. The Kick to Win game can be found in the TXB app.

2. Sponsor

 The Sweepstakes is sponsored by TXB / Kwik Chek, located at 21018 Hwy. 71 West, Suite 300, Spicewood, Texas 78669.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Sweepstakes Period

The Sweepstakes begins on September 01, 2022 at 12:01 a.m. CST and ends on November 30, 2022 at 11:59 p.m. CST (the “Sweepstakes Period”). Entries that are submitted before or after the Sweepstakes Period will be disqualified. Submissions will be accepted for the duration of the Sweepstakes using any of the following methods: On-Site via mobile device utilizing TXB app.

5. How to Enter

Open the TXB mobile app to play the Kick to Win game. The Game utilizes a digital scratcher that can be “scratched” using your finger on your mobile device within the app. The “scratcher” link will also be made available on social media as well as sent via email where users can click on the link to enter their phone number and then receive an SMS link with the game scratcher. Match up 3 of the same items to win that prize. Once you have matched up the 3 items, click on “Get Offer” and then “Redeem” to pull up the coupon barcode or prize instructions. Follow the instructions on the coupon to redeem your prize  On-Site: This method of entry will be available at participating TXB / Kwik Chek Locations throughout Texas and Oklahoma.

Limit one (1) entry per person, per day, per email address, and per household for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

6. Winner Notification

The potential winners will be notified by email, mail or phone. Each potential Grand and Collect to Win Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winners behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Sweepstakes.

7. Prizes

Majority of the prizes will be instant wins where the coupon will contain a barcode to scan at the register to redeem free products typically sold at Participating Locations. The approximate retail value of instant win prizes range from $.79 to $24.99.

To redeem an instant win prize, you must go to any Participating Location, pick up the product described and check out using the TXB mobile app and scanning the barcode provided in the digital coupon. Instant Win Prizes may not be mechanically reproduced and cannot be combined with any other coupons or promotional offers. All Instant Win Prizes must be redeemed by the close of business on November 30, 2022. All Instant Win Prize claims are subject to verification by the Administrator. Limit (1) Grand Prize per person. Select offer coupons will be mailed from the sponsor. You MUST submit the contact form upon winning the prize or prize will be forfeited and no prize will be awarded. TXB will reach back out to your within 72 business hours to coordinate sending the prize. TXB / Kwik Chek employees and members of their family or household are not eligible to win these prizes. Collect to Win prize claims must be received on or before 11:59:59 p.m. CST November 30,2022. Limit (1) Grand Prize per person.

The following are prizes that can be won through the Game, although not a complete & total listing of all prizes available; the below prizes represent the types of prizes available to be won each day through the TXB app during the Kick to Win campaign:

Free Gas for a Year – 1  (Free TXB / Kwik Chek gas for a year. Prize will be awarded as gift cards for fuel. Prize value is determined by the average retail price of regular unleaded gasoline at TXB / Kwik Chek locations during the month of the current year in which the winner was selected. Average price per Gallon multiplied by fifteen (15) multiplied by fifty-two (52).

8. General Conditions

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

9. Release and Limitations of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties)” from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, or in any Sweepstakes-related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

10. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fannin County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Fannin County, Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Fannin County, Texas.

11. Privacy

Information collected from entrants is subject to Sponsor’s privacy policy. Game Sponsor will collect personal data about you to facilitate the Game and for purposes of market research. If you choose to participate in the Game, you grant Game Sponsor permission to send Game updates, winner notification, specials, promotions, newsletters, and/or updates to you. . You also give Game Sponsor permission to share your personal data with Administrator for the purposes of Game administration and facilitation.

No personal data will be transferred or sold to any third party except in the following circumstances:

1. A) When you give us permission to do so;
2. B) When in good faith we believe the law requires it;
3. C) Under limited circumstances specifically described to you when we collect the information;
4. D) To affiliated companies, provided that our affiliated companies and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these Official Rules; and
5. E) To our respective agents, professional advisors, and promotional and marketing agencies, provided that such agents, professional advisors, and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these Official Rules.

Game Sponsor may utilize aggregate information that does not contain any specific personally identifiable information. Game Sponsor may share aggregate information with trading partners, co-branded locations, participating sponsors and advertisers.

12. Winner List

To request the name of the winner send a self-addressed, stamped envelope to TXB / Kwik Chek Office, 21018 Hwy 71 West, Suite 300, Spicewood TX 78669. Winner List requests will only be accepted after the promotion end date (listed above). Please specify “Official Rules” and/or “Winners’ List” with your request.

13. General Terms & Conditions

Participation in the Game constitutes the participant’s full and unconditional agreement to and acceptance of these Official Rules and any decisions of Game Sponsor and Administrator (collectively the “Game Entities”), which are final with respect to all matters relating to the Game.

This Game is void outside the jurisdictions specified in these Official Rules and where prohibited by law. The Game is subject to all applicable federal, state, local, and municipal laws and regulations. The participant will be required to pay any taxes, if applicable, associated with the winning of any prize.

By participating in the Game, and as a condition of acceptance of any prize, each entrant, his/her heirs, executors, administrators, and assigns, RELEASES AND FOREVER DISCHARGES AND HOLDS HARMLESS the Game Entities, their direct and indirect subsidiaries and affiliates, their advertising, promotion and fulfillment agencies and legal and other advisors, and each of their employees, officers, directors, shareholders, partners and agents (collectively, the “Released Parties”), from and against any and all losses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation all costs and liabilities of any kind, including attorneys’ fees), AND INCLUDING WITHOUT LIMITATION ANY LIABILITY ARISING FROM ANY ACT OR OMISSION OF NEGLIGENCE OR INTENTIONAL CONDUCT OF THE PARTICIPANT, that the participant now has, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (a) participation in the Game, or the awarding, acceptance, use, or misuse of any prize, or traveling to, preparing for, or participating in any Game-related or prize-related activity; or (b) the publicity rights granted to the Game Sponsor and its direct and indirect affiliates as referred to above. It is understood that there may be serious risks of bodily injury, death, or property damage associated with the redemption, use or misuse of any prize, and any prize winner voluntarily assumes these risks.

Prizes shall be accepted “as is.” It is understood that the Game entities have not made any warranty, representation, or guarantee, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose, regarding any prize, or any substitute prize. Game sponsor reserves the right to cancel or modify the Game or to amend these official rules at any time, for any reason, and without prior notice.

The Released Parties are not responsible for:

-Any technical, hardware, software or telephone failures of any kind;

-Lost or unavailable network connections;

-Failed, incomplete, garbled or deleted computer, electronic or network transmissions or app issues

-Undelivered coupons due to spam filters, coupon time-out, network connectivity issue or any other reason; or

-Entry requests or prize claims that are illegible, incomplete, misdirected, lost, late, postage-due, damaged, or ineligible.
